XBALM Custom & Promotional Orders

These terms apply to custom and promotional lip balm orders placed at
custom.xbalm.com. XBALM is a brand of Mountain Mixtures, Clearfield, Utah
(“we”, “us”). Placing an order means you accept these terms.
1. What you are ordering
A made-to-order product. Each order is a production run of SPF-15 lip balm
printed with artwork you supply. Nothing is held in stock and nothing is
printed until you have approved a proof.
Minimum quantities are 100 tubes for a single flavor, or 250 tubes and up in
increments of 250, which may be split across flavors.
2. The proof approval process
This is the core of how we work, and it is worth reading.
- You place your order and send us your artwork
- We prepare an art proof and email it to you
- You approve it, in writing, through your account
- Only then does the order go to press
Nothing is printed before that approval. If the proof is wrong, tell us and we
will correct it — there is no charge for revisions at the proof stage.
Your approval is recorded with the date, time and the network address it came
from, along with the shipping address you confirmed at the same moment. That
record is what we both rely on if a question arises later.
3. Artwork
You must have the right to use the artwork you send us. By uploading or
emailing artwork you confirm that you own it or are licensed to use it, and
that printing it does not infringe anyone’s trademark, copyright or other
rights. You agree to cover us for any claim arising from artwork you supplied.
We will tell you if a file will not reproduce well before we use it. We are
not responsible for the quality of the printed result where you approved a
proof made from a file we flagged as unsuitable.
We keep your artwork on file so that reordering is straightforward. Ask us and
we will delete it.
4. Colour, and what a proof can and cannot show
A proof shows layout, wording and placement. It is viewed on a screen, and
screens do not match ink.
Printed colour will be close to your proof but will not match it exactly, and
may vary slightly between production runs. If exact colour matching matters to
you, tell us before you approve and we will discuss what is achievable.
5. Prices, tax and payment
Prices are per tube and depend on the total quantity in your order. The price
shown at checkout is the price you pay.
Sales tax is calculated at checkout where applicable. Shipping is quoted at
checkout from live carrier rates.
Payment is by card in full at the time of ordering. Invoiced terms are
available to established accounts by prior arrangement only.
6. Cancellation
Before you approve your proof: cancel at any time for a full refund.
Nothing has been printed and nothing has been consumed but our time.
After you approve your proof: the order cannot be cancelled. Approval
releases the job to production, materials are committed and printing begins.
The product carries your artwork and cannot be sold to anyone else.

7. Delivery
We ship within the United States. Shipping estimates are given in good faith
and are not guaranteed dates. Risk passes to you when the carrier takes the
shipment.
If a shipment does not arrive, tell us and we will trace it with the carrier.
8. The product itself
XBALM SPF-15 lip balm is an over-the-counter sunscreen product regulated by the
FDA. The drug facts panel, active ingredients and required labelling are fixed
and cannot be altered, moved or covered by custom artwork. Your artwork occupies
the area of the label reserved for it, which is shown on every proof.
Batch codes for a production run are available on request for your records.
9. Limits
Our liability for any order is limited to what you paid for it. We are not
liable for indirect or consequential losses — a missed event date, lost
promotional opportunity, or similar.
Nothing here limits liability that cannot be limited by law.
10. Governing law
These terms are governed by the laws of the State of Utah.
